Lindsay Lohan might not even spend a day in jail

The judge said a violation of her probation would nab Lindsay Lohan 30 days in jail. Well, put on your Macauly Culkin surprised face because that probably won�t happen due to �overcrowding.� The most likely scenario is the judge will sentence Lindsay to 30 days but she�ll be booked and released in an hour or less. Even when Judge Elden Fox remands Lindsay into custody today, Fox will have to set bail which means Lindsay will be out in less time than it takes to heat up a Hot Pocket.

When the probation violation hearing is held next month, it�s likely Judge Fox will sentence Lindsay to 30 days in jail based on the failed drug test for cocaine. As we first reported, the Probation Department will not recommend jail time for the second failed drug test because of an ambiguity in the paperwork.

But this 30-day sentence would be subject to the realities of jail overcrowding, which means Lindsay would go to jail for booking and probably be released an hour or two later.

I need to move to LA because even when I admit to possession of cocaine and violating my probation, the most time I�ll spend in jail is 1 hour. I used to think jail was scary but apparently I was wrong. They put you in a cell for an hour and then release you. Sort of like a timeout. Apparently, jail is just a good way for someone to get some �me� time.

Mel Gibson's ex in tape No 5: 'Why do you hate me so much?'-Detectives receive Mel Gibson audio recordings

A Los Angeles County sheriff's spokesman says detectives investigating Mel Gibson have received audio recordings from a court hearing the actor's child custody matter.







Sheriff's spokesman Steve Whitmore says detectives received the recordings Thursday morning after a court hearing. Several sheriff's detectives were spotted outside a closed hearing where Gibson's criminal attorney and attorneys for his ex-girlfriend appeared.

All of the attorneys declined comment. The sheriff's department is investigating whether the Academy Award-winner abused his ex-girlfriend, Russian singer Oksana Grigorieva, in January.

Whitmore says the detectives received CDs, but did not know how many recordings were on them. He says detectives will now work to authenticate the recordings for a possible criminal case.

And, she says, "You're very mean.""I'd like to show you what mean really is," yells Mel.

Money issues arise again, with Mel saying he needs cash so badly that he has resorted to selling some of his artwork collection. He also says he had to give up his Los Angeles Lakers tickets. "I don't have any (expletive) money! I have to support you and everybody else! I have to sell paintings. I have to sell my box at the Lakers game," Gibson screams.

Oksana's lawyers will be in court this morning asking a family law judge to strip Mel of custody of their daughter, using the tapes as evidence Mel is dangerous, reports TMZ. The authenticity of the tapes is likely to be raised.

On the Today show this morning, an audio expert who has worked for the FBI and CIA verified that the tapes are legit.

Mel Gibson's camp has not commented.










Man charged with stalking Jennifer Garner, family

Steven Burky was arrested at the nursery school where Violet, one of Garner's two daughters with husband Ben Affleck, is enrolled.

A man arrested outside a school attended by the daughter of Jennifer Garner and Ben Affleck has been charged with felony stalking and violating a restraining order protecting the family.




Steven Burky, 37, was arrested in Santa Monica on Monday at the nursery school where Violet Affleck, one of the couple's two daughters, is enrolled.

He pleaded not guilty at an arraignment Thursday afternoon and was ordered held on $300,000 bail, District Attorney's spokeswoman Jane Robison said. A judge also ordered him to stay 500 feet away from Garner, Affleck and their family if released.

A phone message left at Pennsylvania number listed for Burky was not returned Thursday. Robison said he was represented in court by a public defender.

Burky was charged with two counts of felony stalking and two counts of violating a court order, a misdemeanor. A criminal complaint filed in the case alleges Burky harassed Affleck and Garner and made credible threats that place both "in reasonable fear" for the safety of their family.

Garner was granted a restraining order against Burky in November 2008 after she told the court she believed he posed a threat to her and her family. Garner said Burky had been stalking her since 2002.

The former star of the television series Alias, Garner has also appeared in films such as Juno and The Kingdom.

Affleck won an Oscar in 1997 with Matt Damon for writing the screenplay to Good Will Hunting. He and Garner married in June 2005.

Garner, Affleck and their daughter are covered by a restraining order that is due to expire in November 2011. Burky was to stay 100 yards away from the family's cars, homes and schools.
